Ecuador Court Reverses Decision, Approves Casino Referendum
Ecuador’s Constitutional Court has revised its previous ruling, approving the inclusion of a question on casino operations in the upcoming national referendum. The decision, issued as Ruling 9-25-CP/25, marks a significant shift from the Court’s stance just a month ago, when it rejected the proposal for being unclear and combining multiple issues into one.
According to the Court, the new version of the question ensures “clarity and freedom for voters,” allowing citizens to make a well-informed choice during the November 16 referendum.
Background: From Rejection to Reconsideration
The government initially proposed the referendum to include a clause allowing casinos to operate within luxury hotels, along with other political and structural reforms. The Court originally dismissed the plan, citing ambiguity and poor question design.
After adjustments were made, however, the Court has now reconsidered and approved the measure, opening the way for Ecuadorians to decide on the future of legalized gaming.
Casinos May Return to Five-Star Hotels
If voters approve the measure, casinos could make a comeback in Ecuador for the first time in more than ten years but strictly within five-star hotel establishments.
Tourism data shows the country currently hosts around 134 luxury hotels, strategically located across major provinces. Quito leads with 16, followed by Guayaquil (9), Cuenca (8) and several others in Manta, Loja and the Galápagos Islands.
Supporters say the initiative could revitalize tourism, attract foreign investors and generate new employment opportunities. Opponents caution that reopening casinos may also increase addiction risks and exacerbate social inequalities.

The referendum is considered a turning point for Ecuador’s economic and political trajectory. Legalizing casinos could strengthen the tourism and entertainment sectors while also sparking debate over social responsibility and regulation.
With more than a hundred hotels eligible to apply for gaming licenses, the potential economic impact could be substantial. However, critics insist that any revival of gambling must come with robust consumer protections and oversight.
