NSW Revokes Pokies Exemptions Ahead of 2026 Shutdown
New South Wales (NSW) is set to overhaul its gaming machine regulations, as the state’s Labor Government announces that all exemptions allowing venues to bypass the mandatory 4am–10am shutdown will end on 31 March 2026.
Previously, more than 670 venues could operate outside the shutdown period under three main exemptions: weekend and public holiday variations in tourism zones, financial hardship allowances and special approvals for “early opener” venues. The government’s review concluded these exemptions, some in place for two decades, are now outdated and largely unmonitored.
NSW Minister for Gaming and Racing David Harris emphasised that the variations “no longer reflect current risk profiles or community expectations,” and confirmed that venues will still be able to apply for hour variations under a revamped, stricter process.
The reforms follow mounting pressure from political opposition and public health advocates. Research commissioned by the state highlighted that gaming machine players face increased harm after midnight and many venues operating under old exemptions were no longer meeting the original criteria. Notably, some hardship-approved venues remained among the highest-grossing operators in 2023.
Minister Harris stated the changes are designed to balance harm reduction with support for an industry that employs more than 150,000 people and contributes billions to the state economy. Venues believing they have valid grounds to retain exemptions can appeal before the 31 March deadline, though all applications will be assessed against tighter standards by the independent regulator.
