Argentina Tightens Online Gambling Advertising Rules

Argentina’s Ministry of Economy, through its Secretariat of Industry and Commerce, has introduced new regulations that significantly tighten advertising standards for online gambling and betting. Resolution 446/2025, published on 3 November 2025, mandates prominent health warnings and stricter visibility requirements for all gambling-related advertising across television, radio, digital platforms and influencer marketing.

Mandatory Health Warnings Across All Media

The new framework requires all gambling advertisements to feature two clear messages: “EL JUGAR COMPULSIVAMENTE ES PERJUDICIAL PARA LA SALUD” (“Compulsive gambling is harmful to health”) and “+18.”

These warnings must appear within the advertisement frame, spanning the entire width at the bottom and covering at least 10% of the total space. The text must be bold, horizontally aligned and use contrasting colors for maximum readability.

The law applies uniformly to all advertising formats, ensuring that gambling promotions are clearly marked as adult content and carry consistent health warnings.

Stricter Rules for Influencers and Digital Promotion

A notable addition in the regulation targets influencers and public figures. Whenever an influencer mentions or promotes an online betting platform, the health warning must remain visible for the full duration of the mention.

The measure aims to curb the growing influence of social media personalities who promote betting platforms to young audiences without disclosing potential risks. Regulators believe continuous warning display will enhance transparency and help protect vulnerable users.

Audio and Radio Advertising Requirements

For radio and audio-based ads, the regulation stipulates that the mandatory warning must be clearly audible at the end of each advertisement. It must be spoken slowly, without background music or overlapping voices and delivered at a pace no faster than the rest of the content.

These rules are designed to prevent the rushed or obscured disclaimers often used in current radio and streaming spots.

Oversight and Citizen Reporting

To strengthen compliance, the Ministry has launched a dedicated reporting system that allows citizens to submit complaints against influencers or companies failing to include the required disclaimers. This initiative is expected to reinforce accountability and encourage responsible marketing practices within the gambling industry.

Promoting Responsible Gaming and Public Health

Officials emphasized that the new rules do not prohibit betting-related advertising but aim to ensure ethical standards and consumer protection. The initiative underscores Argentina’s commitment to responsible gaming and the prevention of gambling addiction.
